French President Emmanuel Macron and German Chancellor Friedrich Merz submitted their proposal to Commission President Ursula von der Leyen. Their joint effort emphasizes the need for expedited measures when external nations compromise fair competition within the EU. Additionally, they aim to develop a more robust legal framework to handle situations that current trade measures cannot resolve promptly.

    The suggested reforms would empower the European Commission to implement wide-ranging countermeasures against third countries when serious market distortions pose a threat to the single market. In the most critical cases, the tool might enable immediate exclusion from the EU market. Macron and Merz also proposed a reverse qualified majority voting system for authorizing actions, where measures would become effective unless a qualified majority of member states opposed them.

    The two nations additionally advocate for a dedicated diversification mechanism aimed at reducing excessive reliance on particular suppliers of essential goods. Their document highlights threats associated with dumping, extensive subsidies, supply chain concentration, and other practices that distort fair competition. France and Germany stressed that the EU requires tools capable of responding decisively and systematically. While the proposal does not explicitly target any specific country, it coincides with ongoing EU scrutiny of trade relations with China.

    Renewed Attention on EU Trade Defense Capabilities

    The European Commission has welcomed the Franco-German proposal, describing it as a valuable addition to ongoing discussions about economic risks and global trade imbalances. The EU currently employs anti-dumping, anti-subsidy, and safeguard measures to counteract unfair or disruptive trade practices. It also introduced the Anti-Coercion Instrument, which took effect in December 2023, allowing the bloc to respond when a non-EU country exerts trade or investment pressure to influence EU policies.

    The proposed rapid-response mechanism aims to address a wider array of market distortions and accelerate the decision-making process within the EU. France and Germany want the Commission to act more swiftly without waiting for the usual political approvals. Their approach shifts the decision-making burden to member states that oppose the measures. EU leaders are scheduled to convene in Brussels on October 15 and 16, shortly after the proposal from France and Germany was submitted to the Commission.

    China Criticizes the EU’s Proposed Trade Control Measures

    On October 6, China’s Ministry of Commerce responded by urging France and Germany not to advance what it described as protectionist EU tools. The ministry emphasized that economic interdependence should not be viewed as a risk and called for continued support for open trade. It also cautioned against turning economic and trade disagreements into broader security issues. Beijing has separately criticized discussions surrounding stronger EU instruments that could limit Chinese companies or products.

    This initiative comes amid ongoing negotiations between EU and Chinese officials concerning trade imbalances, export restrictions, and other commercial disputes. EU trade authorities have also increased monitoring of persistent import growth and industrial overcapacity. France and Germany stated that their proposed framework should be applicable across countries rather than singling out one trading partner. The European Commission will evaluate the proposal alongside existing trade defense tools and the EU’s comprehensive economic security strategy.
